This Privacy Policy ("Policy") describes how we collect and use personal data in cases where Abeeway is responsible for the processing of such data or where we mention the applicability of this Policy. Any information about you or another identifiable person constitutes "Personal  Data”. 

 

Other information notices may also be presented to you when using our products or services. In the event of any discrepancy, the terms of these notices shall prevail over those of this Policy.

The software installed on your device may have access to your personal data. Our products or services may contain links to the websites of other companies and other services that apply their own privacy policies. Abeeway declines all responsibility for these practices, and we recommend that you read them.

What information do we collect?

 

We collect your personal data and other information when you make a purchase, use or register our products, subscribe to our services, participate in campaigns or surveys, or otherwise interact with us, including in the following cases:

Product and service activations:  Abeeway products and services may require electronic activation. During this operation, the following information is transmitted to Abeeway: type of your terminal and application, unique identifiers of your terminal, application, network and subscription.

Use of products and services: When you access our online services, our web servers automatically record your visits. These records generally include IP address, access times, sites that redirected you, pages viewed, links and features used, content viewed or searched for, browser or application type, language, and other such information. Our applications may regularly contact our servers, for example, to check for available updates or to send us information about the use of our services.

Information you provide to us: When you create an account, make a purchase, make a service request, participate in surveys or campaigns, or otherwise interact with us, we may ask you for certain information, such as your name, email address, phone number, mailing address, usernames and passwords, comments, information about the devices you use, your age, gender, language, and other banking data such as your bank account number or credit card information. We also store your consents, preferences and settings, for example regarding your location data, marketing use or the sharing of your personal data.

Your transactions with us: we keep records of your purchases, downloads, content you have provided to us, requests, agreements between you and Abeeway, products and services provided to you, information about payments and deliveries, your contacts and communications, and any other interaction with us. We reserve the right, in accordance with applicable laws, to record your communications with our customer service or any other similar point of contact.

Location and positioning data:  Location services establish your location using satellite, cellular, Wi-Fi or other location methods. These technologies may involve sharing your location data as well as unique identifiers of terminal Wi-FI, the tracker information and various events of the tracker such as motion events, SOS event. Our products may operate on multiple platforms, applications and services that are also likely to collect your location data. We do not use this information to identify you personally without your consent.

When you use our location services and features, such as our search, navigation and guidance features, or requests for map data, your location data is sent to Abeeway in order to provide you with the appropriate content. Users are responsible for any third-party Personal Data obtained, published or shared through this Application and confirm that they have the third party's consent to provide the Data to the Owner.

 

Mode and place of processing the Data

Methods of processing

We take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the owner of the data, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors.

 

Personal Data relating to Users may be processed if one of the following applies:

·       Users have given their consent for one or more specific purposes. Note: Under some legislations the owner may be allowed to process Personal Data until the user objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of Personal Data is subject to European data protection law;

·       provision of Data is necessary for the performance of an agreement with the user and/or for any pre-contractual obligations thereof;

·       processing is necessary for compliance with a legal obligation to which the owner is subject;

·       processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the owner;

·       processing is necessary for the purposes of the legitimate interests pursued by the owner or by a third party.

In any case, the owner will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

 

Place The Data is processed at the owner's operating offices and in any other places where the parties involved in the processing are located. Depending on the user's location, data transfers may involve transferring the user's Data to a country other than their own. We guarantee that your personal data is not shared or sold without your permission. At Abeeway, protecting your privacy is of the utmost importance. We are convinced that data can be useful to the collective interest once made anonymous. In addition, the perspectives offered by our products and services allow you to make informed choices and lasting changes. The data you have generated and collected through Abeeway's digital products and services are processed for the purposes indicated below. Please note that different purposes may apply simultaneously.

Provision of products and services: we may use your personal data to provide you with the products or services you have requested, to respond to your requests or for any other purpose necessary for the performance of the contract concluded between you and Abeeway. We may also use your personal data to ensure the functionality and security of our products and services, to identify you and for the purposes of preventing and detecting fraud and other abuses.

Accounts:  Access to certain services requires the creation of an account to help you manage your content and preferences.

Development and management of products and services: we may use your personal data to develop and manage our products, services, customer support, sales and marketing. We may combine personal data collected in connection with your use of a specific Abeeway product and/or service with other personal data held about you anonymously, except where it has been collected for other purposes.

Communications with you:  We may use your personal data to communicate with you, for example, to inform you that our products and/or services have changed, to send you critical alerts and other warnings about our products and/or services or to contact you through our customer support department.

Marketing, advertising and recommendations:  we may contact you to keep you informed of new products, services or promotions we offer and conduct market research, with your consent or if otherwise permitted. We may also use your personal data to personalize our offer and provide you with more tailored services, for example, to issue recommendations and display personalized content and advertisements in our services. This may include displaying Abeeway content and third-party content.

Research studies:  When Abeeway shares data for research purposes, it is always anonymized and aggregated so that no link can be made between a data or set of data and a particular person. The sharing of data for research purposes is carried out with professional partners such as hospitals, researchers, other companies, or with the public through scientific articles and studies.

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.

Do we share your personal data?

We do not sell, rent, or otherwise disclose your personal data to third parties, except in the circumstances mentioned below.

Your consent and social sharing services: we may share your personal data after obtaining your prior consent. Some services may allow you to share your personal data with other users of the service or with other services and their users. Always be careful before disclosing your personal data or other information that may be accessible to other users.

• You are aware that the location data will not be shared to any other third party but this personal data may be shared by the subscriber account or mobile APP since they have credentials to Abeeway backend.

Abeeway group companies and authorized third parties:  we may disclose your personal data to Abeeway group companies or authorized third parties, who process personal data on behalf of Abeeway for the purposes described in this Policy. This may include, for example, billing your network operator, delivering your purchases, providing services such as customer service, managing and analyzing consumer data, credit checks, conducting studies, and managing sales and other campaigns. When you purchase an Abeeway product as part of a network service provider plan, we may exchange information with your network service provider in order to provide you with such a service.

We may carry out commercial and communication campaigns in collaboration with our partners, for example your mobile operator to avoid duplication or unnecessary communications and to personalize the message to you, we may need to reconcile the data collected by Abeeway with those collected by the partner where permitted by law.

These third parties are not allowed to use your personal data for any other purpose. We ask them to act in accordance with this Policy and to employ appropriate security measures to protect your personal data.

International transfers of personal data: our products and services may be provided through resources and servers located in different countries around the world. Therefore, your personal data may be transferred outside the country where you use our services, including countries outside the European Economic Area (EEA), that do not have laws that provide specific protection for personal data, or have different data protection laws, as is the case in the United States of America. In these cases, we guarantee the existence of a legal basis for this transfer as well as an adequate level of protection of your personal data, in accordance with the laws in force, using, for example, agreements approved by the relevant authorities (if necessary) and requiring the use of other technically and organizationally adequate measures to protect the security of the information.

Mandatory disclosures:  We may be required by law to disclose your personal data to certain authorities or other third parties, for example to law enforcement agencies in the countries where we, or third parties acting on our behalf, operate. We may also disclose and process your personal data in accordance with applicable law to defend Abeeway's legitimate interests, for example in civil or criminal proceedings.

Mergers and acquisitions:  In connection with a sale, acquisition, merger or acquisition or any other restructuring of our business in certain countries, we may disclose personal data to potential or existing acquirers and their advisors or receive personal data from sellers and their advisors.

How do we ensure children's privacy?

Abeeway products and services are generally aimed at the general public. Abeeway does not intentionally collect information about children without the prior consent of their parents or legal guardians. Abeeway publishes safety tips regarding the use of Internet services on our websites.

 

How do we approach data quality?

We take reasonable steps to maintain the accuracy of the personal data in our possession and to delete any incorrect or unnecessary personal data.

We invite you to regularly access your account and verify that your personal data is accurate and up-to-date.

What measures do we take to protect your personal data?

Privacy and security are critically important in how we create and deliver our products and services. We have assigned specific responsibilities to address security and privacy issues. We enforce our internal policies and guidelines through a selection of appropriate activities, including proactive and reactive risk management, security and privacy engineering, training and assessments. We take appropriate measures to ensure online security, physical security, eliminate the risks of data loss and other risks taking into account the risk posed by the processing and the nature of the data that is protected. We also limit access to our databases containing personal data to only authorized personnel with a justified need to access that information.

 

How do we use cookies and web beacons?

Abeeway uses cookies, web beacons and other similar technologies relating to app local settings : the app retains some information for the purpose of improving the usability of the app like authentication tokens, added trackers MAC addresses and other settings. These settings are stored locally in the app private folder and will be erased as soon as the user has des installed the app.

  

What are your rights?

The rights of Users

Users may exercise certain rights regarding their Data processed by the Owner.

In particular, Users have the right to do the following:

·       Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.

·       Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent.

·       Access their Data. Users have the right to learn if Data is being processed by the owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing.

·       Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected.

·       Restrict the processing of their Data. Users have the right, under certain circumstances, to restrict the processing of their Data. In this case, the owner will not process their Data for any purpose other than storing it.

·       Have their Personal Data deleted or otherwise removed. Users have the right, under certain circumstances, to obtain the erasure of their Data from the owner.

·       Receive their Data and have it transferred to another controller. Users have the right to receive their Data in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that the Data is processed by automated means and that the processing is based on the User's consent, on a contract which the User is part of or on pre-contractual obligations thereof.

·       Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the owner or for the purposes of the legitimate interests pursued by the owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection.

Third party services

We do not share personally identifiable information (such as name or email) with other companies.

App store operators may store a user’s information that we do not have access to, including payment information to the users that have premium subscriptions. To review a user’s permissions in those app stores, an Android user should go to Google account privacy   and an iOS users should visit Apple account privacy. On this link, a user may also receive data collected by Apple and/or deactivate and delete their accounts.

We use Analytics services in order to have a better understanding of how visitors generally use our apps and website, so we can improve it over time. These services store cookies to be able to anonymously identify visitors. For this purpose, we use Google Analytics. They use this data solely on our behalf. They do not share it except in aggregate form. This information is processed in a way that does not identify you, nor anyone visiting the website. Additionally, we do not store any of the information above. We set the Analytics platform to erase any data after 50 months since the last access. Please view the Google Analytics privacy policy . Whenever a crash or malfunction is detected we use the Google Crashlytics Service to solely help us improve the stability of the app on all devices. For each crash, we collect the data necessary to resolve the problem like operating system, device, etc. you can check the data collected by the Crashlytics service. service.

 

Changes to this Policy

Abeeway reserves the right to modify this Policy or and, with or without notice, to block access to this site at any time, or to change the conditions of access. However, if this Policy were to be significantly modified in a way that might be unfavourable to you, Abeeway would publish a notice informing internet users of this modification at the top of this Policy and on the home page of this site, for 30 days. We advise you to regularly review this Policy for any changes.
